Speeding on P's

Last night I was driving home and I overtook someone going down a hill and I didn't break after overtaking and I got done at the bottom of the hill.

I was given a $371 fine and was clocked at 20kph over. I'm on my P's but he didn't take my license... Am I still going to lose it I don't know how it happens?

As far as I know, they never take your licence away on the spot for speeding (or even tell you that you've lost it) until a few weeks later when you get a letter.

If you are lucky you might get away with 3 point deduction.
Assuming you have more then 3 points on your license.

NSW red plater points = 4

exceed speed by more then 20kph = 4 points

The new rules mean that any red p plater caught speeding will loose their license, the only difference is the size of the fine.

In NSW, if you're doing >45 km/h - you are suspended on the spot for at least 6 months. Officer will ask and retain your licence and take it back to the cop shop. You'll be told to secure your car and told clearly you cannot drive as your licence is suspended. Until such time a magistrate overturns it if you contest it.

Are you P1?
"Licence suspension for speeding – Your licence will be suspended for at least three months for any speeding offence."

If you >30km/h you get to walk for 3 months
If you >20km/h less than 30km/h you get 4 demerit points

As for your situation, if you have too many demerits, the suspension starts from when you pay the fine, basically by paying the fine, you admit that you have committed the offence, in effect you are saying "no contest".
So get the fine, and hold off until you are ready to walk for 3 months, probably the warmer spring months would be an idea. Unless of course your rego is up before then, and then you wont be able to rego your car anyway until outstanding fines are paid. So your hand may be forced.

If you got clocked at 20kph over the limit do you really think you needed to overtake the guy? U speed because you speed, nobody else's input or responsibility.
You will have to suck it up and learn for next time. Bottom line dont speed, dont get in trouble, end of story.

No it won't. Not with NRMA. They don't care and there is no mechanism for automatic reporting between state registries and insurance companies. Unless of course they specifically ask you to detail such offences when you renew. I've heard this wive's tale a lot, never seen it happen in practice.

Take it to court. Just yesterday a workmate of mine got done in similar circumstances. It was over Easter, double demerits. He was clocked at 20+km/h over, but the copper was nice and put 10km/h over only on the ticket, thinking it'll save him some money. But being on his P's, any speeding offence, let alone when double demerits are in force, equals loss of license. He took it to court, the judge was reasonable and he didn't lose his license - just have to stay out of trouble for the next 2 months, and attend a driving school 2 hrs a week or something for those 2 mths.

I think Daniel has learned his lesson, unfortunately the hard way. But the only way to go is move on and be a better motorist because of it.

There is no excuse for speeding or disobeying any traffic rule at all. Trust me, if you stick to the speed limit you more often than not end up with a speeding driver stopped at the next light anyway You will get where you're going to and THAT is what's important.

I've had my license for 13 years and not a single demerit point.. and trust me, in this span of over a decade I have never ever ever been inconvenienced by not speeding in getting to where I want to go.

If you did it, you should accept the punishment.
Just because it doesn't suit you doesn't mean you deserve a reduction...
