He could have just sold his car, paid back the money and ended this thing a long time ago. This court proceedings will mess his entire future up both with a criminal record and future financial loans. For a relatively smart guy, how the hell did he not think of the easiest and honest outcome?

One thing to keep note is this isn't exactly a court case it was a tribunal case (QCAT)....

He was served with the application paperwork and had the oppurtunity to respond via written correspondence, there never was a hearing he was summonsed to...

He could have just sold his car, paid back the money and ended this thing a long time ago. This court proceedings will mess his entire future up both with a criminal record and future financial loans. For a relatively smart guy, how the hell did he not think of the easiest and honest outcome?

Unfortunately this is only now a civil matter and he won't receive any criminal charges out of it all. None-the-less it's likely he'll end up with a bad credit rating though....

Oh and don't forget about the Core i7 desktop and new dual screen monitors he has bought, even since this fraud was picked up and first reported about on here. Ultimately we've been funding his lifestyle, but hopefully that will soon be over!

smithsy, there was a court case pending, he just didnt respond to the summons to the hearing.

i`ve unlocked this thread and put it on the news for 1 week, again, please NO SPECULATION, we dont have our money back yet

*shrug* I don't understand why he is just doesn't front up and deal with it now. It's not like it's going to go away for him. Even if he genuinely can't afford it now, he at least could've made some undertakings to pay it once he had a job or something. I guess we will see how it pans out.
So what's the next step in terms of this default judgement.

There is no court case, it is a tribunal matter. (Remember the whole point of the tribunal is to remove the need for a lawyer making it cheaper and also to speed things up)

It clearly describes the process whereby he was served with the application forms (not a summons), chose not to respond, hence the decision by default. Had he of responded it would of went to mediation and then probably a tribunal hearing but thankfully his lack of response has sped things up.

court case/tribunal hearing, its semantics smithsy, u can still be represented legally and u still stand before a judge for a ruling.

and he WAS summoned, THATS what the bailiff SERVED on him.

Will it ever get to a point where you can contract someone to legally re-posess his car or belongings, or will you need to sue him in a courtroom?

It still seems like these medial proceedings are being considered as 'laughable' by Adrian as he knows he can do an "OJ Simpson" and never pay back the money.
